High Court: Judiciary should not interfere in govt policy decisions

The High Court has remarked that the judiciary should not interfere in the government's policy decisions. 

The bench of Justice Sheikh Hassan Arif and Justice Md Bazlur Rahman made the observation on Thursday during the hearing on a writ demanding the formation of a commission to look into the killing of children by helicopter gunfire and compensation for the victims during the recent student movement.

Petitioner lawyer Taimur Alam Khondkar argued for immediate compensation to the families of the slain children. 

In response, Attorney General Md Asaduzzaman requested the court to defer the hearing until the government decides on the compensation policy for the affected families. The attorney general also said the government would soon determine the amount of compensation and the policy to be followed.

During the hearing, the High Court highlighted that the judiciary should refrain from intervening in government policy decisions, referencing past issues arising from such interference, including the Court's previous ruling on quota restoration.

Following the hearing, the High Court issued a ruling requesting an explanation for why an international commission of inquiry would not be established to investigate the shootings and why compensation of Tk1 crore would not be awarded to the families of the deceased children. The court scheduled the next hearing for September 5.

The writ petition filed by Supreme Court lawyer Taimur Alam Khondkar seeks a judicial inquiry led by a High Court judge and compensation of Tk1 crore for each child killed in the student movement.
