5 people including former mayor sued for illegal appointment

Barisal City Corporation (BCC) has filed a case against five people, including the former mayor, for illegally appointing another person by stopping the salary of an officer appointed on contract as a network engineer.

Sheikh Md Swaib Kabir, who was appointed contractually as a network engineer in the city corporation, filed the case in the Barisal Senior Assistant Judge Court on Tuesday afternoon.

The case was accepted by Judge Hasibul Hasan and is currently pending a decision, as confirmed by Bench Assistant Md Bayazid.

The defendants named in the case include former mayor Serniabat Sadiq Abdullah, the chief executive officer, the member secretary of the contractual recruitment committee, the budget cum accounting officer, and Obaidur Rahman, who currently holds the networking engineering position.

According to the plaintiff’s complaint in the case, a recruitment notice for the position of Network Engineer at the Barisal City Corporation was published on a contractual basis on November 19, 2020. Swaib Kabir secured the top position in both the written and oral examinations and was subsequently appointed on a three-year contract starting from May 9, 2021. 

The city corporation duly paid his regular salary up until January 4, 2023, after which, for reasons unknown, his salary was discontinued.

Despite his contract not having expired, another individual was appointed to the same position in violation of government regulations. 

On September 17, Swaib Kabir approached the city corporation, seeking the disbursement of his salary and allowances and requesting the cancellation of the new appointment. However, the defendants refused to pay his salary and dismissed his plea. Consequently, Swaib Kabir filed a lawsuit aiming to annul the illegal appointment and secure his salary and allowances.
