A writ has been filed with the High Court, challenging the legality of the Detailed Area Plan (DAP) gazette notification published on August 23.
Supreme Court lawyer Eunus Ali Akand filed the petition on Sunday, saying that the gazette violated the Town Improvement Act,1973, Water Bodies Protection Act, 2000 and Acquisition and Requisition Act, 2017.
Relevant authorities including the development authority Rajdhani Unnayan Katripakkha (Rajuk) chairman have been made respondents to the rule.
On August 23, the housing and public works ministry published the gazette notification for the new DAP to be effective till 2035. At the same time, the 2010 DAP was cancelled.
According to the gazette, the draft for the DAP (2016-2035) for 1,528 square km area under Rajuk for the Dhaka Metropolitan area was published on 2020.
After that, calls were made to hear objections regarding the draft. It was approved after taking the objections into consideration.
However, the writ claimed that many will suffer due to the new gazette.
It said that the government cannot cancel the previous DAPs and change its water bodies, but it approved the DAP defying the provisions.
According to Eunus Ali, one of his 5 katha plot in Bashundhara area has been included in the recent DAP though even though it was not included in the 2010 DAP.
As a result, Rajuk is not providing him with a no objection certificate for building a house in his plot, as a 200-feet road will be constructed through his land.
In his petition, the lawyer moved the High Court to issue a stay on the effectiveness of the new DAP.
