Rabbi dropped from N'ganj by-poll

The High Court has dropped the petition filed by Rafiur Rabbi challenging the cancelition of his nomination in Narayanganj by-poll.

The HC said: “The court will not allow Rabbi to contest in the Narayanganj 5 by-election scheduled to be held on June 26 as he was a loan defaulter.”

The bench of Justice Mirza Hussain Haider and Justice Khurshid Alam Sarkar on Monday said: “We will reject the writ petition of Rabbi, if he wants to continue the further proceedings. But, if he want to move it to another bench, he can.”

In response, the petitioner's lawyer Shah Md Munir Sharif requested the Hc bench to drop the petition from it's case list.

Earlier on June 1, the Election Commission scrapped his nomination paper. Later, Rabbi appealed against the decision but the commission rejected the appeal on June 5.

Then he lodged a writ petition with the High Court on June 9 saying his company was defaulter not he himself.

But the HC bench led by Justice Mirza Hussain said as Rabbi was the managing director of the company, he could not be exempted from the loan default.

After the death of Nasim Osman, a lawmaker from the Jatiya Party, Narayanganj 5 seat fell vacant.
