Writ filed to stop legal practice by MPs

A writ petition has been filed seeking stoppage of legal practice by Supreme Court (SC) lawyers after they become members of parliament (MPs).

Yunus Ali Akand, a lawyer of the SC, filed the petition, which will be placed on Monday for hearing in the division bench comprising Justice Sheikh Hasan Arif and Justice Md Nazrul Islam, reports BSS.

The secretary of the law ministry, registrar of Bangladesh Bar Council and the SC were made respondents to the writ petition, Yunus said.

In accordance with Article 68 of the Constitution, the post of an MP is an office of profit, he added.

There are some conditions for the lawyers to do practice as per the Rule 8 of Bangladesh Bar Council and this rule does not allow any lawmaker to practise in the court of law, the petitioner said.

As the parliament has power to remove the SC judges, there is an apprehension of influencing the court by the concerned lawyers cum MPs, he opined.
