A Dhaka court yesterday acquitted Bashundhara Group Chairman Ahmad Akbar Sobhan, his son Sadat Sobhan, and an employee in a fraud case filed against them over a land and flat transfer.
Metropolitan Magistrate Muhammad Erfan Ullah framed charges against two of the accused and ordered to start the trial.
The accused were Vice Chairman Mahbub Morshed Hasan and Deputy Managing Director Md Towhidul Islam of East West Property Development Private Limited.
All of the accused, except for Sadat Sobhan, were present before the court during the order.
On the other hand, the court acquitted East West Property Development Private Limited chief Ahmad Akbar Sobhan, his son and director of the company Sadat Sobhan, and Assistant General Manager MA Hasan.
The court also granted an extension of their bails on the basis of a bail extenuation petition.
Court also fixed next date for witness testimony on December 10.
Plaintiff’s counsel Habibur Rahman said they would appeal to the Higher Court for a review of the acquittals.
According to the case, filed in 2011 by Jalal Ahamed Spinning Mill Limited chief Selim Ahmed, the plaintiff accused the defendants of misappropriating Tk3.95 crore deposited as a payment for three plots in the Bashundhara Housing.
Following an investigation by the Tejgaon police, the court issued arrest warrants against the accused on May 27 2012.
Except for Sadat Sobhan, all the others secured bail from the court and later appealed to the High Court against the case. The High Court rejected the plea on September 16 last year.
