A Dhaka court yesterday set February 2 to hear the petition on cancellation of bails of six accused in Jahangirnagar University student Zubair Ahmed murder case while police said in a probe report that the accused recently assaulted and threatened two students seeking justice for the killing outside the court.
The report came upon a general diary filed by Nazmul Islam, one of the two victims and activist of Shontrasher Biruddhe Jahangirnagar with Old Dhaka’s Kotwali police against six of the 13 accused on January 19. All the accused, members of Bangladesh Chhatra League, were granted bail from the High Court.
Sub-inspector Md Rafiqul Islam investigated the incident that happened around 1:30pm in front of the entrance of the Dhaka Judge’s Court in presence of university’s Estate Officer Azim Uddin, also a witness of the case, when friends of Zubair were leaving the court after observing the case proceedings.
Public Prosecutor SM Rafiqul Islam told the Dhaka Tribune: ‘‘On the next hearing day, the court will hear the bail cancellation appeal [which he filed on February 23].
“The bail cancellation matter depends on the court’s order. Since the investigation says the incidents occurred and the accused committed the crime, their bail should be cancelled for violating the bail conditions.”
According to the general diary, six of the accused had attacked Nazmul and Rajibul Islam. Of them, Khandaker Ashikul Islam Ashik threatened Nazmul saying: “You are carrying out movement, very well. But remember if we are not hanged, another will die on the campus.”
The students’ platform alleges that many of the 13 accused often stay on the campus defying the bail conditions and the expulsion order given by the university authorities. The Syndicate after the killing expelled seven of them for life while the others for two years as their direct involvement in the killing was proved.
So far, seven prosecution witnesses have testified at the court. In his deposition, Azim on January 19 had favoured the accused under undue influence, said the public prosecutor after the day’s proceedings.
The university authorities filed the case with the Ashulia police after Zubair, an honours final year student of English (batch 2007-08) and also a former Chhatra League activist, succumbed to his injuries on January 9, 2012. The day before, he was brutally hacked and beaten on the campus by the accused 13 and their accomplices.
