A Dhaka court has issued a warrant against Lakeshore Hotel managing director Kazi Tareq Shams and his associate MA Masud on charges of breach of trust and fraud.
Judge Mohammad Hossain Muhammad Jonayed of Dhaka's Additional Chief Metropolitan Magistrate Court No. 4 issued the order on August 31.
The case alleges that Kazi Tareq Shams, with the help of his associate MA Masud, fraudulently registered Lakeshore Hotel shares in their own names, taking advantage of the frail condition of his father Kazi Shamsul Haque, who was suffering from old age-related illness and amnesia.
The victim's siblings filed a case in court regarding this incident.
The plaintiff's lawyer Barrister Al Mamun Rasel said: "The defendants, in collusion with each other, took advantage of their father's illness and fraudulently registered all the shares in their own names to deprive the heirs. The CID investigated the case twice and submitted a report to the court finding the primary truth of the fraud.”
“After reviewing the report and documents, the court took cognizance of the case and issued summons against the defendants. And after issuing the summons, the defendants did not appear in court, so the court issued a farewell warrant. We believe that through this order, the plaintiff has made important progress on the path to justice,” he added.
Despite repeated attempts, Kazi Tareq Shams could not be reached for a comment.
The court mentioned in its order that the preliminary truth of the crimes under sections 406 (breach of trust), 420 (cheating) and 109 (incitement/aiding) of the Penal Code against the defendants was found in the investigation report and the review of the relevant documents.
As a result, the court accepted the investigation report, took the case into consideration for trial and ordered the issuance of summons against the two defendants.
After issuing the summons and the accused did not appear before the learned court, the court issued a warrant.
