The Supreme Court chamber judge on Thursday upheld a High Court order that directed the Chief Metropolitan Magistrate's Court in Dhaka to accept, hear and dispose of the bail petitions filed by BNP Secretary General Mirza Fakhrul Islam Alamgir in nine cases.
Justice M Enayetur Rahim, chamber judge of the Appellate Division, passed the order after hearing a petition filed by the state challenging the order of the High Court.
The apex court chamber judge also sent the petition to its full bench.
It also fixed January 15 to hear the petition.
Attorney General AM Amin Uddin appeared for the state while Zainul Abedin and Sagir Hossain Leon stood for Fakhrul.
The High Court on Monday directed the Dhaka Chief Metropolitan Magistrate (CMM) Court to hear bail petitions in nine cases filed against BNP Secretary General Mirza Fakhrul Islam Alamgir in connection with the 28 October incidents and dispose of those cases.
On December 14, Mirza Fakhrul Islam Alamgir filed a writ seeking guidance to address the bail petition in the cases filed at the Ramna police station and Paltan police station.
Currently, these cases are awaiting resolution in the CMM court in Dhaka.
On October 29, Fakhrul was arrested in the case filed with Ramna Police Station over the attack on the residence of the chief justice during a clash with police on October 28.
