Declaration suit filed against 13 Supreme Court Bar Association members

A declaration suit was lodged against 13 executive members of Supreme Court Bar Association (SCBA) including the Secretary General Barrister Md Ruhul Quddus Kajol.

Barrister M Ashraful Islam lodged the declaration suit on Tuesday with the Fifth Joint District Judge GM Nazmus Sadat's Court in Dhaka.

Ashraful Islam said the court accepted the suit and issued summons against the defendants. The court later set February 24 as the date for returning the summons.

According to the case statement, the plaintiff alleged that all the activity of the association after the death of SCBA president Abdul Matin Khasru on May 4 last year, are illegal under Section 12 of Supreme Court Bar Constitution.

The section stipulates that all meetings of the association must be presided over by the president, the secretary or an assistant secretary under the direction of the secretary. 

As the association does not have a president now, all executive committee activities from February 1, this year are illegal.

The plaintiff also stated that the defendants have approved budgets totaling Tk25 crores in different sectors.
