A writ was filed with the High Court challenging a Bar Council notice that said from now students will not be allowed to sit in the written exam for a second time after passing the preliminary exam of advocateship enrollment examination.
Supreme Court Lawyer Advocate Shishir Muhammad Monir filed the writ with the High Court’s virtual vacation bench of Justice Tariq ul Hakim on Tuesday.
On Sunday, the Bangladesh Bar Council issued a notice that said, due to amendment of the rules those who failed in the written exam before September 19, 2018, will not qualify to sit in the written exam for a second time.
However, the council on December 15, 2019, had issued a notice, saying those who failed in the written examination earlier, do not need to sit for the preliminary examination for a second time.
Following the notice, 3,590 examinees did not sit for the preliminary examination in February and were waiting for the upcoming written exam.
Advocate Shishir said the Bar Council misinterpreted the amended rules. Obviously the candidates who were waiting for the examination should get the opportunity to sit for the written test for a second time.
The sudden change in decision by the council is completely unacceptable, he added.
