Man released from jail after being mistakenly arrested, court issues show cause notice

Md Salam Dhali has been released from jail on Monday, after he was mistakenly arrested on March 1 this year.

Police had mistaken Md Salam Dhali for escaped burglar Md Abdus Salam, who skipped bail after being convicted in a case filed with Mongla police station in 2005.

On Sunday, a writ was filed with the High Court seeking the immediate release of the innocent Salam Dhali. After the filing of the writ, the officer-in-charge of police station concerned filed an application with the Bagherhat Judicial Magistrate’s Court.

On Monday, the court issued an immediate release order to the jail as well as a show cause letter to responsible police officer Sanjit Kumar Mandal, sub-inspector (SI) at Sonadanga Model police station. The SI must explain his mistake within seven working days.

Supreme Court lawyer Advocate Mohammad Shishir Monir had filed the writ petition seeking the release order form the High Court.

The writ had also urged the High Court to take necessary action against the person who is responsible for the wrongful internment and provide appropriate compensation to the misidentified Md Salam Dhali.

Md Salam Dhali is the son of Safiz Uddin. 

Md Abdus Salam, son of Mafiz Uddin Dhali in Bagerhat, was sentenced to two years imprisonment by the Bagerhat Senior Judicial Magistrate’s Court for a case filed in 2005. He fled bail after having already been arrested and has been on the run ever since.

Later, pursuant to the arrest warrant, SI Sanjit Kumar Mandal arrested Md Salam Dhali on March 1, 2020, after mistaking him for the actual convict because they had similar names.
