Bus owners file writ to evade paying Rasel Sarkar Tk50 lakh despite HC order

Bangladesh Bus Owners Association filed a writ petition on Tuesday with the Supreme Court, in an effort to evade compensating Rasel Sarkar, who lost his leg in an accident in Dhaka’s Dholaipar area on April 28 last year.

Bangladesh Bus Owners Association on Tuesday filed a Civil Miscellaneous Petition (CMP) with the Appellate Division of Supreme Court against the High Court order that asked Green Line Paribahan to compensate Tk50 lakh to Rasel Sarkar on March 12.

Advocate Khandaker Shamsul Haque Reza, lawyer for Rasel, told Dhaka Tribune: "We heard about the association filing a CMP to seek a stay order. The court may hold hearing on the petition on Wednesday."

He added the owners association was not part of the initial petition they had filed, but will observe the matter nevertheless.

In this petition the association also requested the Supreme Court to make them a party in the case.

Meanwhile, Advocate Abdul Matin Khasru, a senior lawyer of the SC refused to move the case on behalf of Bangladesh Bus Owners Association.

Earlier on April 4, the High Court ordered Green Line Paribahan to pay Tk50 lakh to Rasel Sarkar by April 10.

The High Court also asked Green Line Paribahan not to sell its tickets for April 11, if they do not pay the money complying HC directives.

On April 28 that year, a luxury Green Line coach rear-ended the car Rasel was driving. The accident occurred on the slope of Mayor Md Hanif Flyover in Dholaipar, and caused Rasel to step outside of his car to assess the damage.

Although he signaled the bus not to drive away, bus driver Kabir Hossain, in his attempt to flee the scene, ran over Rasel, severing his left leg from the thigh down in the process.

After being informed, police impounded the bus and detained Kabir from near the National Press Club.

Rasel also told Dhaka Tribune over phone that no one contacted him from Green Line Paribahan.
