Split order: Khaleda’s lawyers to file no-confidence motion

BNP Chairperson Khaleda Zia's lawyers have decided to file a no-confidence motion with a one-man High Court bench, fearing they will not get justice in the petition relating to cancellation of her nominations.

The bench was formed on Wednesday to hear the writ petition over the cancellation of the former prime minister's nomination papers for three constituencies.

After Khaleda's lawyer AJ Mohammad Ali told the court that they did not bring a written petition with them on Thursday, the court asked them to file it in writing and issued a “not today” order, reports UNB.

It informed them that the case will be on Saturday, December 17 cause list and said they can submit their petition to the High Court or the chief justice.

Earlier, the BNP chief’s nominations for Feni 1, Bogra 6 and 7 constituencies were rejected during scrutiny by the returning officers of those seats.

The Election Commission also upheld the decisions later on December 8, prompting the BNP chief to move the High Court the next day.

On Tuesday, the bench of Justice Syed Refaat Ahmed and Justice Md Iqbal Kabir issued a split order on Khaleda's candidature.

Senior Justice Refaat had stayed the commission’s decision and accepted her appeals, while Justice Iqbal upheld the commission’s decision.

Later, the appeal was sent to Chief Justice Syed Mahmud Hossain as per rules to form a new bench.

Khaleda was jailed for five years on February 8 in the Zia Orphanage Trust corruption case. Her jail term was doubled by the High Court on October 30.

A day before that, she was also sentenced to seven-year imprisonment in the Zia Charitable Trust graft case.
