HC judge feels embarrassed to hear plea on Nizam Hazari’s MP status

A High Court judge on Sunday felt embarrassed to hear a petition that challenged the legality of parliament membership of Awami League leader Nizam Uddin Hazari. The bench of Justice Md Mozibur Rahman Miah expressed embarrassment to hear the petition over the legality of Nizam holding a parliamentary seat and sent it to the Chief Justice. The Chief Justice will assign another High Court bench for hearing and disposing of the petition. Earlier, the Chief Justice assigned the Justice Miah’s single bench for final disposal of the petition. Advocate Kamrul Haque Siddiqui represented the petitioner while advocate Yusuf Hossian Humayun stood for Nizam Hazari. On December 6 last year, a High Court bench delivered a split verdict on a petition challenging the legality of the ruling party MP’s parliament membership. Senior judge of the bench, Justice Md Emdadul Huq, had declared the election of Nizam as the Feni-2 constituency MP illegal, while the bench’s junior judge, Justice FRM Nazmul Ahasan, rejected the petition. In 2014, Shakhawat Hossain Bhuiyan, a Jubo League leader of Feni, filed the petition with the High Court, attaching a newspaper report of May 10 that year, stating that Nizam was awarded 10 years of imprisonment in an arms case, but had been freed from prison two years and 10 months before his jail term was completed.
