War crimes convict Jamaat-e-Islami leader Mohammad Kamaruzzaman cannot be executed before getting the full copy of the tribunal verdict, claims Defence Counsel Khandakar Mahabub Hossain.
He made the statement while addressing a press conference held at the Supreme Court auditorium on Wednesday afternoon.
He said: “The jail authorities must have the copy of the full verdict of the Appellate Division to execute Kamaruzzaman. It will be illegal if he is executed before the jail authorities get the full copy of the verdict.”
However, later in the day, Attorney General Mahbub-e-Alam has opined that the full copy was not necessary for the jail authorities to execute the war criminal as the apex court has only upheld the tribunal's verdict.
Regarding the issue of filing a review petition, the defence counsel said: “As per section 105 of the constitution, there is a scope to file a review petition against the apex court verdict.”
“We have submitted a review application in order to get justice. We will file the review petition after getting the full copy of the verdict.”
On November 3, the Appellate Division of the Supreme Court gave death penalty to the former al-Badr man Kamaruzzaman for committing crimes against humanity during the Liberation War of Bangladesh in 1971.
