Chief Justice Surendra Kumar Sinha told the Attorney General Mahbubey Alam that he was making compromises with the administration for political gains.
The chief justice made the remarks during a hearing on three leave-to-appeal petitions on Wednesday against a High Court order banning mobile courts.
When Attorney General Alam told the court that banned 'Current Jal' was still in use, the chief justice pointed out that the court had banned its use.
Alam said his house was by the river Padma, adding, “I still see Current Jal being used.”
Chief Justice Sinha replied: “What can we do if the law enforcement agencies are not vigilant enough?
“I have heard that you visit your locality as you are planning to contest the next election. You continue to compromise with the administration.”
Earlier, the chief justice said he would give the attorney general a list of the sections of Mobile Court Act that contradict with the Code of Criminal Procedure (CrPC).
“These sections should be fixed,” he said, telling Alam that operating mobile courts with executive magistrates was in the government's best interest.
He said the court could judge cases without overstepping its legal boundary.
Attorney General Alam sought time to prepare.
Then the six-member Appellate Division bench extended a stay till October 10 on a High Court order that declared the operation of mobile courts illegal.
