‘Notary public has no authority to settle divorce’

Law Minster Barrister Shafique Ahmed on Saturday advised the Marriage Registrars not to register any marriage and divorce accepting any affidavit from notary public who has no such legal authority.

Inaugurating the national grand rally-2013 of Bangladesh Muslim Niqah (marriage) Registrar Samity, he said Allah hates divorce and that is why Islam calls for appointing ‘hakam’ or mediator to resolve the differences between the husband and the wife.

In this regard, the Union Parishads and the City Corporations have been empowered to form ‘hakam’ or `salish’ (arbitration) board, said Barrister Shafique.

He said that if the salish board fails to resolve the dispute over the divorce within the stipulated 90 days, then it will issue a certificate for the registration of divorce.

The law minister also asked the marriage registrars to be careful in registering marriage, taking cognizance of the birth and citizenship certificates and guardian’s affidavit as Muslim Shariah Law does not allow child marriage.
