The Chamber Judge of the Appellate Division of the Supreme Court has suspended the High Court order to stop the operation of battery-powered rickshaws in Dhaka Metropolitan area.
On Monday, the order was issued by the Chamber Judge Md Rezaul Haque.
Earlier, following a preliminary hearing on a writ petition, the High Court issued a directive along with a rule on November 19.
The directive ordered the cessation of or restrictions on the operation of battery-powered auto-rickshaws on Dhaka Metropolitan roads within three days.
This directive was issued to the Home Secretary, Inspector General of Police (IGP), Dhaka Deputy Commissioner, administrators of the two city corporations, and the Dhaka Metropolitan Police Commissioner, among others.
Seeking a suspension of this directive, the government filed an appeal with the Appellate Division on Sunday. The appeal was heard on Monday in the Chamber Court of the Appellate Division.
Attorney General Md Asaduzzaman represented the state during the hearing, while lawyer HM Sanjid Siddiqui appeared on behalf of the writ petitioners.
The writ petition challenging the inaction regarding the restriction or ban on battery-powered auto-rickshaws in Dhaka Metropolitan was filed on October 27.
Zahidul Islam, President of the Greater Dhaka City Corporation Rickshaw Owners’ Association, and General Secretary Md Momin Ali were the petitioners in this writ.
