HC's observes that bail petition is ‘unprecedented’ in full text verdict
The Appellate Division has adjourned hearing of Ron Haque Sikder, managing director of Sikder Group, and his brother Dipu Haque Sikder, in a case filed on charges of abducting, torturing and threatening to shoot two top officials of Exim Bank over a loan, for two weeks.
A six-member Appellate Division bench led by Chief Justice Syed Mahmud Hossain passed the order on Sunday.
Earlier on July 20, the High Court bench of Justice Md Ashraful Kamal rejected the anticipatory bail petition filed by the two accused after a virtual hearing.
The bench also ordered the accused to provide 10,000 items of personal protective equipment (PPE) to the Prime Minister's Relief and Welfare Fund within two weeks as a fine, since they submitted bail petitions beyond legal statutes and therefore wasted the court's valuable time.
On Sunday, the HC released the 112-page full text of the bail rejection order verdict with some observations, terming the Sikder brothers’ bail plea in advance from abroad as “unprecedented and the first in history.”
The High Court said: “There is no scope for applying for anticipatory bail while staying abroad. Such an illegal and unethical appeal should be abandoned. Such an unprecedented appeal is the first in human history. It is certainly astonishing. Other courts across the globe observed the appeal with surprise and they are startled and dumbfounded at seeing the supreme excellence of our legal system.”

The court also rebuked Lawyers Abdul Baset Majumdar and Ajmalul Hossain QC and Supreme Court Bar Association President AM Amin Uddin for representing the brothers during the bail appeal. Ajmalul Hossain QC joined the bail hearing virtually from London.
The court said running a case from abroad is illegal and unethical. The accused going abroad without managing bail or notifying the court is illegal. The applicants dared to ignore the country's law and court. The bail application said their ‘rivals’ would harass them by using and influencing the administrative mechanism, which is a sheer exhibition of distrust of the government and administration. The authorities concerned will take necessary steps against them.
On July 2, Sikder Group chief Ron Haque Sikder and his brother, who are now in Thailand, filed the online application seeking anticipatory bail from the High Court’s virtual bench.
On May 7, Ron and Dipu Haque Sikder allegedly tortured and attempted to murder Exim Bank Managing Director (MD) Md Haider Ali Mia and Additional MD Md Firoz Hossain. They shot at the Exim Bank officials at Sikder House in Dhaka's Banani when the bankers refused to overvalue their mortgaged property for a Tk500 crore loan.
A case was filed in this connection with Gulshan police station on May 19.
National Bank Limited, a concern of the Sikder Group, denied the allegations through their lawyer Abdul Baset Majumder, saying the case was filed to socially defame them.
The brothers took a private air ambulance of R&R Aviation, another Sikder Group concern, and left the country on the morning of May 25. News of their departure came to light on May 29.
