The stay order will continue till disposal of the HC rule issued in this regard in May last year, and the Green Line does not need to pay the installment following the SC order, told the lawyer

The Appellate Division of the Supreme Court has stayed a High Court order that asked Green Line Paribahan to pay Tk40 lakh by installment to Russel Sarker, who lost his leg after a bus of the company ran him over last year.

Following a petition challenging the HC order, a four-member bench of the Appellate court headed by Chief Justice Syed Mahmud Hossain passed the order on Sunday.

According to the lawyer, the transport company has already given Tk10 lakh in two installments and Tk3.5 lakh as medical expenses to Russel Sarker.

The apex court’s decision came after the chamber judge sent the matter to the appellate court for hearing when Green Line Paribahan challenged the High Court order earlier.

On July 29, Green Line Paribahan paid Tk5 lakh as monthly installments to Rasel Sarker.

The court said the rest of the money--Tk40 lakh-- have to be paid as monthly installments of Tk5 lakh each to the victim.

It also fixed September 7 for the payment of another installment while the next hearing in the case will be held on October 17.

On July 21, the court ordered Green Line Paribahan to pay first installment within one week.

On July 16, the court said: "They [Green Line] have not complied with the court's order to pay a monthly installment of Tk5 lakh."

The same day, Green Line Paribahan Counsel Wazi Ullah withdraw his name from the case as the transport company has been repeatedly disobeying the court’s order.

Earlier on June 25, the High Court asked Green Line Paribahan to pay a compensation of Tk5 lakh monthly installment to Rasel, to clear the remaining Tk45 lakh of accident and injury compensation.

The court had also asked Green Line's lawyer to pay the money by the seventh of each month, and submit a compliance report by the 15th.

On April 10, Green Line paid Tk5 lakh to Rasel, and the court allowed it one month's time to pay the remaining Tk45 lakh.

On March 31, the Appellate Division of the Supreme Court upheld the High Court order that had asked Green Line Paribahan authorities to give Tk50 lakh to Russel.

On April 28, 2018, a luxury Green Line coach rear-ended the car Rasel was driving. The accident occurred on the slope of Mayor Md Hanif Flyover in Dholaipar, and caused Russel to step outside of his car to assess the damage.

Although, he signaled the bus not to drive away, but bus driver Kabir Hossain -- in an attempt to flee the scene-- ran over Russel, severing his left leg from the thigh down in the process.

After being informed, police impounded the bus and detained Kabir.
