A writ will be filed with the High Court if Moazzem Hossain – former OC of Sonagazi police station in Feni – involved in the Nusrat Jahan Rafi murder case, does not surrender or is not arrested by 16 June.
Barrister Syed Sayedul Haque Suman, plaintiff in the case, said this talking to reporters on Tuesday.
He said: “An arrest warrant has been issued on 27 May. People, including victim Nusrat's family, are waiting for Moazzem's arrest.”
“I thought he will appear at the High Court for anticipatory bail. But such a petition did not come up in the cause list. By wasting time, it shows that he [Moazzem] is playing cat-and-mouse with all stakeholders,” he added.
The regular hearing will resume from June 16, he said, adding that within that time if Moazzem is not arrested, he would file a writ with the High Court asking why the failure of the police to act should not be declared illegal.
“To the best of my knowledge, police can clear out cases if they really want to. There are many examples where police caught the accused within 24 hours of the filing of a case. They arrested the 16 accused involved in Nusrat's murder case from different places in the country,” he said.
“The Police Bureau of Investigation (PIB) investigated for a month and in the report, Moazzem was an ‘offender’ in the case. Then, why did they not keep him under police surveillance? The delay in his arrest has affirmed people’s belief that the police does not want to arrest Moazzem,” Barrister Suman added.
