Dhaka Women and Children Repression Prevention Tribunal-3 Judge Joyoshree Samaddar issued the order
A Dhaka court on May 6 cleared 11 people, including Jatrabari police station Officer-in-Charge Kazi Wazed Ali Mia and two of his officers, sub-inspectors ASM Mahmudul Hasan and Laizu, of rape charges.
Dhaka Women and Children Repression Prevention Tribunal-3 Judge Joyoshree Samaddar issued the order after accepting a judicial inquiry report, which cleared the 11 accused of the charges in the case.
On April 4, a case was filed with the tribunal against 11 people over the alleged gang-rape of a woman on March 12.
The 11 accused are OC Kazi Wazed Ali Mia, and SIs ASM Mahmudul Hasan and Laizu, Md Shafiqul Islam Roni, Md Sagar, Md Shamim, Md Alauddin Delwar Hossain, Md Hanif, Md Swapon, Bilkis Akhter and Farzana Akhter.
After recording the complainant's statement, the tribunal ordered a judicial inquiry report after an investigation.
On April 30, Metropolitan Magistrate Sharafuzzaman Ansari submitted the judicial inquiry report to the Women and Children Repression Prevention Tribunal-3 in Dhaka.
The tribunal also discharged the case as no evidence of rape was found against the accused.
The complainant, in her deposition, also mentioned that no rape incident had occurred. She claimed the case was initiated over a misunderstanding, and she didn't want to pursue it.
Special Public Prosecutor Mahmuda Akter told Dhaka Tribune that the woman would not run the case in the future.
11 were accused in the case
In the original case statement, the 27-year-old woman—a mother of two—said she had been struggling to provide for her family after her husband abandoned them. She claimed that she had been victimized by a gang while she was desperately searching for work.
The prime accused in the case, Md Shafiqul Islam Roni, allegedly lured her to a flat owned by Farjana Akhter Shashi and Bilkis Akhter Shila at Koratitola in Old Dhaka on March 12, with the promise of a job in an online women’s clothing store.
At the flat, Roni and his cohort Md Swapan allegedly raped her. When the woman started screaming for help, Farjana and Bilkis reportedly put a knife to her throat and threatened to record the rape, prompting her to stay quiet.
Later, accused Jibon, Biplob, Hanif, Sagar and Alauddin, along with some other youths, allegedly beat her up and raped her again. Eventually, she was able to escape from the flat.
Victim seeks help
Later, one Nazmul Hossain took her to Md Rezaul Karim, a human rights activist. With his help, she went to Jatrabari police station, but did not receive any help from the police. Nazmul then sought help from the assistant commissioner of police of Demra zone, where they were asked to wait for him, but he did not appear.
They then went to SI Laizu. He led a drive and arrested Shashi and Bilkis with 18 yaba pills, and allegedly demanded Tk1 lakh from the complainant to give to OC Wazed and two other officers for filing a case.
Since the woman was not able to pay the amount, she was produced before a court as a sex worker under the DMP Act. The police filed a general diary over the matter.
The woman, who lives in Keraniganj, was released from the court after paying a fine of Tk200.
