HC revokes expelled AL leader’s bail over Subarnachar gang rape

The attorney general says actions will be taken against the criminal defence lawyer

The High Court on Saturday has revoked the bail granted to Ruhul Amin- the prime suspect in Subarnachar gang rape case.

The bench of Justice Mamnoon Rahim and Justice SM Kuddus Zaman, recalled their previous decision after the state realized that the criminal defence lawyer had misled them.

The court also fixed March 25 for the next hearing.

Following the court’s decision, Attorney General Mahbubey Alam said he will petition the authorities to take action against the defence and move the court to hold the attorney in contempt of court.

"Ruhul's lawyer Ashek-e-Rasul informed us that the hearing to secure Ruhul's bail would be held before the bench of Justice M Enayetur Rahim. 

"However, the lawyer held the hearing before the bench of Justice Mamnoon Rahman instead, and secured the bail by concealing Ruhul's confession and the victim's statement," Mahbubey said.

He reassured that if the all information surrounding the case had been produced before the court, it would not have granted the bail petition.

Calling the incident "unprecedented," Mahbubey said the whole nation was shocked at the court’s decision to grant Ruhul bail. 

"However, I extend my gratitude to the High Court, as they promptly took counter measures, even on their weekend," he said.

If necessary, the matter will notified to the bar council and the chief justice, for actions against the criminal defence lawyer, he also added. 

Earlier on Thursday, the same bench had granted one-year interim bail to Ruhul Amin – prime accused in the gang-rape of a housewife from Noakhali’s Subarnachar, following the December 30 polls.
