The Appellate Division of the Supreme Court on Tuesday refused to stay a High Court order to provide Tk 20 lakh as compensation to the family of Jihad, who died after falling into an abandoned deep tube-well in Shahjahanpur area of the city on December 26, 2014.
Chamber Judge Syed Mahmud Hossain sent the appeal of the Fire Service and Bangladesh Railway authorities to the regular bench of the Appellate Division fixing February 5 for the next hearing, said Advocate Md Abdul Halim.
Attorney General Mahbubey Alam argued for Railway and Fire Service.

Earlier on October 9, the High Court released the full text of its verdict ordering to provide the compensation to the family of Jihad.
As per the verdict, the HC asked the Railway and Fire Service to provide Tk 10 lakh each to the family of Jihad within 90 days of getting the full text of the verdict.
On February 18, 2016, an HC bench comprising Justice Farah Mahbub and Justice Kazi M Ejarul Haque Akond asked the government to compensate Tk20 lakh to the family members of four-year-old boy who met the tragic end of his life inside a 600-foot abandoned shaft of a water pump at Shahjahanpur Railway Colony.

Halim filed a writ petition with the High Court on December 28, 2014 seeking its directives for providing Tk 30 lakh as compensation to Jihad's family members.
The body of Jihad was pulled out from the abandoned shaft 23 hours after he had slipped into it.
