Writ seeks immediate release of a misidentified person

Advocate Shishir said the virtual bench may hold the writ hearing on Monday

A writ has been filed with the High Court (HC) seeking an immediate release order for an innocent person who is behind the bars instead of the convict who has the same name.

The writ also urged the High Court to take necessary action against the person who is responsible for the wrongful internment, and provide appropriate compensation to the misidentified, Md Salam Dhali.

Supreme Court lawyer Advocate Mohammad Shishir Monir filed the writ with the High Court's virtual bench of Justice M Enayetur Rahim on Sunday.

Recently different media had published news about the imprisonment of Md Salam Dhali, son of Safiz Uddin, in place of Md Abdus Salam, son of Mafiz Uddin Dhali in Bagerhat.

According to a published report, Md Abdus Salam was sentenced to two years' imprisonment by Bagerhat Senior Judicial Magistrate for a case filed in 2005. 

The original accused was arrested following the case which was filed for burglary with the Mongla police station back then, but he somehow managed to get bail and since then is on the run. 

Later, pursuant to the arrest warrant, Sanjit Kumar Mandal, Sub-Inspector (SI) at the Sonadanga Model police station arrested Md Salam Dhali on March 1, 2020, mistaking him for the actual convict because of them having a similar name.

Advocate Shishir said the virtual bench may hold the writ hearing on Monday.
